The Melbourne Magistrates’ Court: What to Expect
The Melbourne Magistrates’ Court is located at 233 William Street in the Melbourne CBD, directly opposite the County Court and diagonally across from the Supreme Court. It is the court where all criminal matters involving adults commence. The court also hears summary criminal matters, including traffic offences, and handles family violence and personal safety intervention order applications.
Arriving at Court
Ensure you arrive at the court well before the time your matter is listed. Dress neatly and conservatively, and be prepared to spend most of the day at court. Upon arrival, you will need to go through security and then check in at the court registry. If you have legal representation, your solicitor will handle these procedures for you.
Parking and Transportation
The Melbourne Magistrates’ Court does not have dedicated court parking. There is usually ample parking around the streets surrounding the court building, but it can be limited during business hours. Various car park buildings are nearby, and access by train is convenient via the Flagstaff station, located just a half block down William Street. If you are attending court for traffic offences that may result in a licence disqualification, do not drive to court, as you may not be permitted to drive home.
Courtroom Procedures
A court list is displayed in glass frames in the foyer of the Melbourne Magistrates’ Court, just to the right wall before the elevators. You can find out which courtroom and level your matter will be heard by looking at those screens or asking at the court registry. Inform the court of your presence at the counter before heading into the courtroom. Intervention Order matters are usually heard on level 6, and criminal matters on level 3. The court registry can assist you with directions and information on speaking to the prosecution or obtaining assistance from a duty lawyer.
Range of Matters Heard
While the Melbourne Magistrates’ Court generally deals with matters where the alleged offending conduct occurred in the CBD or inner suburbs of Melbourne, it also hears cases where the accused resides in the inner suburbs or the CBD. Magistrates Courts are also located in the eastern, northern, and western suburbs of Melbourne, serving local communities.
